Terms of Service

These Terms of Service ("Terms") are an agreement between you and The III Marketing ("we," "us"), which operates PostTheMarket at theiiimarketing.com (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who can use PostTheMarket

You must be at least 18 and hold an active real estate license in Florida, or be otherwise authorized by your MLS to use its data. You agree that the information you give us, including your license number, is accurate. We may verify your license and may suspend accounts we can't verify.

2. Your account

Keep your password private and tell us right away at support@theiiimarketing.com if you think someone else has accessed your account. You're responsible for activity under your account. Accounts are for one person and may not be shared.

3. Free trial, billing, and automatic renewal

• Free trial. New accounts get a 14-day free trial with every feature included. We may ask for a payment method to start the trial.
• Automatic renewal. Unless you cancel before your trial ends, your subscription starts automatically and you'll be charged $19.99 per month, plus any applicable taxes, on the day your trial ends and on the same day each month after that, until you cancel.
• Reminder. We'll email you before your trial ends to remind you that your subscription is about to start.
• Cancelling. You can cancel anytime from your Profile page, with no phone call or email needed. See our Cancellation & Refund Policy.
• Payments. Payments are processed by Stripe. We don't store your full card number. If a payment fails, we may pause your access until it's resolved.
• Price changes. We'll give you at least 30 days' notice by email before any price increase, and you can cancel before it takes effect.

4. MLS data, estimates, and reports

Market data comes from realMLS (the Northeast Florida Multiple Listing Service) and is deemed reliable but not guaranteed. You agree to follow your MLS's rules on the use and display of its data. Home value estimates are automated calculations based on recent sales. They are not appraisals, broker price opinions, or comparative market analyses, and should not be the sole basis for any pricing or financial decision.

5. Your marketing and legal responsibilities

You're responsible for everything you publish or send using the Service. That includes following:

• Florida real estate advertising rules, including displaying your brokerage as required;
• the federal Fair Housing Act and related laws, including Meta's rules for housing advertising if you promote posts;
• email marketing laws such as CAN-SPAM, including only emailing people who've agreed to hear from you and honoring opt-out requests promptly;
• privacy laws that apply to the leads you receive.

6. Acceptable use

You agree not to:

• share MLS data in ways your MLS doesn't allow, or resell reports or data;
• scrape, copy, or bulk-download the Service or its data;
• use the Service to send spam, or submit fake or misleading leads;
• upload content you don't have the rights to, or that is unlawful or misleading;
• interfere with the Service, try to access other accounts, or get around usage limits or security measures.

7. Your content

You keep ownership of what you upload, like your photo, logo, and brokerage details. You give us permission to store, process, and display that content as needed to run the Service for you, for example placing your photo on your reports and posts.

8. Leads

When someone requests a home estimate through your link, we share their contact information with you. You agree to use it only to respond to them and for related real estate services, in line with applicable law and our Privacy Policy.

9. Third-party services

The Service relies on third parties such as Stripe, realMLS, email providers, and social networks. Their own terms apply to your use of them, and we aren't responsible for their availability or actions.

10. Ending your account

You can stop using the Service and cancel at any time. We may suspend or end your access if you break these Terms, misuse MLS data, or fail to pay. If we end the Service entirely, we'll give reasonable notice and won't charge you for time after it ends.

11. Disclaimers

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, including warranties of accuracy, fitness for a particular purpose, and uninterrupted availability.

12. Limitation of liability

To the extent the law allows, we won't be liable for indirect, incidental, or consequential damages, or for lost profits or lost business. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity

You agree to defend and hold us harmless from claims arising from your marketing, the content you publish or send, your use of leads, or your violation of these Terms or the law.

14. Governing law

These Terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Duval County, Florida.

15. Changes to these Terms

We may update these Terms. If we make important changes, we'll email you or post a notice in the Service before they take effect. Continuing to use the Service after that means you accept the updated Terms.
